Fair Use in Digital Media (the story of Kind of Bloop)

A Perfect Circle Portland fans, my photos will be posted by midday today.

Almost two years ago, I posted about an interesting 8-bit tribute album of Miles Davis’ Kind of Blue called Kind of Bloop.  I like it, more in concept than execution, but I liked the music nonetheless.  Well, the guy who put it together Andy Baio (who also helped start Kickstarter) got in hot water with the original photographer Jay Maisel for Digital Millennium Copyright Act (DMCA) violations.  He settled out of court, but was he in the wrong?  Personally, I think not.

I mean, his use of the photo was altered in a way that appears consistent with the fair use provisions in the copyright law.  Check out the full read over on the waxy.org article “Kind of Screwed“…

Help 12-yo blues singer Savanna (Kickstarter)

I’m here to promote music.  When that music is also made by friends, it’s even more fun to promote.

When I moved to Eugene, I got involved in a most excellent vegetarian supper club.  The founders, Josh & Sharon Coen, are super great… it’s a really fun group.  Well, when we moved here, we met their (then) 9 year old Savanna.  About two years ago, she started singing and has been gigging more and more in the Eugene area… whether it be Saturday Market, Kidz Rock, Grrrlz Rock, or blues festivals – it’s been great to see Savanna and her talent grow.

Well, now 12 years old, she’s starting a Kickstarter campaign to get her first CD made.  If you’ve never heard about Kickstarter, it’s a great new way to be financially active in an independent venture – music or otherwise.  I’ve done a couple Kickstarters recently (Kevin Moore‘s Shine and GdEB‘s Jazz).  Anyway, it’s a great way for those who want to support art to put their money where their mouth is.

Fan funding is what it’s all about.

So, my question for you… do you want to help this talented 12-year old blues singer from Eugene, Oregon, make her first CD?  Of course you do!  As little as $10 gets you the music. Go to:

Kevin Moore’s “Shine” artwork

As reported about 2 months agoKevin Moore (Chroma Key, O.S.I., ex-Dream Theater) is putting out SHINE – the score to the Turkish film Kucuk Kiyamet (2007).  The Kickstarter micro-funding goal was easily met, and production is underway.  Here is a 6-panel digipack classic Penguin Books-style mock up of the artwork done by Alessandro Falca of Conte di San Pietro:

Alessandro is also currently working on the poster and T-shirt design. The digipack is now finalized and will go to the manufacturer next week. Kevin is hoping to ship preorders late November or early December (2010).
